The WCAB Appeals Process

If your claim is denied or you disagree with a decision, you can file an appeal with the Workers' Compensation Appeals Board (WCAB).

Steps in the Appeals Process:

  1. File an Application for Adjudication: This formally opens your case with the WCAB
  2. Declaration of Readiness: Filed when your case is ready for a hearing
  3. Mandatory Settlement Conference: Attempt to resolve disputes before trial
  4. Trial: Present evidence before a Workers' Compensation Judge
  5. Decision: Judge issues Findings & Award or Opinion on Decision
