Dispute Resolution and Arbitration
Any dispute, controversy, or claim arising out of or relating to your use of this website or these Terms of Use shall first be resolved through good-faith negotiation between the parties.
If the dispute cannot be resolved through negotiation within 30 days, the parties agree to attempt to resolve the dispute through mediation before a mutually agreed-upon mediator in Los Angeles County, California.
If mediation is unsuccessful, any remaining dispute shall be resolved by binding arbitration administered by JAMS in Los Angeles County, California, in accordance with its Streamlined Arbitration Rules and Procedures. The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court having jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
This arbitration provision does not apply to disputes arising from or related to an attorney-client relationship, which shall be governed by the retainer agreement.
Limitation of Liability
To the fullest extent permitted by law, the Law Offices of Nathan Howser shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or reliance on information contained herein.
